It was a surprise to a lot of people when Bush failed to do mass pardons in the final days of his presidency. This leaves the decision to President Obama. Is Obama going to follow the law or is he going to pardon the Bush administration by declining to enforce the law? I think it would be a mistake for Obama to allow Bush to break the law and get away with it. It would send a message to future criminals that if you do something really bad you might be too big to prosecute. That would be the wrong message to send. I believe that much of the lawlessness today started when Ford pardoned Nixon. We are a nation of laws and if we don’t prosecute serious crime when done by political leaders then it says that politicians are above the law.
